Man found dead, another charged with murder

Timothy Carl Mundt, 48, has been arrested by the Bottineau County Sheriff’s Department in the shooting death of another Westhope man, Jessie Kirk, 40, in Westhope.

The formal complaint, which was issued Friday, alleges that “on or around” Feb. 5 Mundt shot and killed Kirk with a rifle, a Class AA felony.

Mundt is being held at the Bottineau County Sheriff’s Department with bond set at $500,000 cash or corporate surety. The bond was set Monday by Pierce County District Judge John C. McClintock Jr., because the Bottineau judge was on vacation, according to Anthony Swain Benson, assistant state’s attorney for Bottineau County.

Details regarding the circumstances of the alleged murder and the discovery of Kirk’s body are being withheld, although one person close to the victim reported that he had been missing for two days prior to being discovered.

“As far as the facts of the case go, it’s a closed file,” Benson said. “I want to keep the facts until he has an attorney involved.”

A preliminary hearing for Mundt has not yet been set.
