Child sex abuse charges reduced against nurse

Howard Michael Lemere, who currently lives in Montana, was sentenced Tuesday to two counts of contributing to the deprivation of a child, both class A misdemeanors, in Ward County District Court in Minot.

Lemere had been charged with gross sexual imposition against a minor less than 15 years old, a class AA felony. A jury trial for the previous charge was set to begin Tuesday but was canceled. Lemere had been employed as a nurse at Trinity Hospital in Minot at the time the incidents took place, at a private residence.

“It was the best way to resolve this matter for everybody involved,” said Kelly Dillon, the assistant state’s attorney for Ward County who prosecuted the case. “There are factors that we have to take into account such as protecting the child from further trauma.”

The new charges state that Lemere “willfully encouraged, caused, or contributed to the deprivation of” Jane and John Doe, minors “by engaging in sexual conduct in the presence of the minor.”

Lemere is required to pay $300 in court fees and a $25 victim-witness fee and will have to serve one year in the Ward County Jail with credit for 44 days and 261 days suspended.
